Scenario

You are an IT Security Manager at a large Corporate facility engaged in the production of software for the gaming industry. You have recently been faced with 3 major security issues that you must deal with.

1. At a recent trade show you were directed to a small foreign company that is providing products very similar to your own, but at a much reduced rate. You acquire some of the sample DVD’s and forensically analyze them. They contain source code that originated from your company. The foreign company is located in a country that does not normally co-operate with law enforcement, but does conduct a lot of trade in Canada.

Case 1

1. Has the foreign company committed any offence or breach of law? Describe in detail?

2. By using the malware to capture passwords, has the programmer committed an offence? If yes what offence and why?

3. As a supervisor, in a special position of trust, what other offence have they committed? Why?
